Gausnell, O’Keefe & Thomas, LLC co-founder and principal attorney, William Thomas, wrote an article for Modern Contractor Solutions, called “Understanding the Risks and Responsibilities Posed By “As-Built” Documents” In it, Thomas explains the guidelines to follow when handling contracts and construction documents.
Increasingly, custom form construction contracts impose obligations on project participants to produce “as-built” or other “record drawings” at the conclusion of the work. Unfortunately, there is little uniformity in how these documents are prepared, by whom, and in what medium. Further complicating the issue is Owners’ expectation that this responsibility is part of basic services. While these documents are an important tool to the Owner, unless care is taken in their preparation, they can lead to liability for the unwary.
